This document contains important information about your rights and obligations as well as limitations and exclusions that apply to your use of the Flying Furniture Pty Ltd (“Flying Furniture”) website or your order with Flying Furniture. Please read carefully.

Acceptance of Terms

By confirming an order or using the website you agree to be bound by the following terms of use, which shall take effect immediately. As a visitor to the site, you agree to use it for lawful purposes only. Flying Furniture reserves the right to change the site or the terms at any time and from time to time. By continuing to use the site you are bound by any such amendments to the terms and you should therefore periodically check for any amendments or updates.

Privacy Policy

Flying Furniture Pty Ltd’s Privacy Policy forms part of the terms of use and by agreeing to the terms of use you also agree to the Privacy Policy. The privacy of our site, visitors and subscribers and the security of their email and physical addresses are of paramount important to us. No personal information will be given, traded, sold, released or otherwise communicated in any form to any third party.

The laws of the Australian Capital Territory, Australia govern the use and interpretation of content communicated and it is a condition of use of this web site that you submit to the exclusive jurisdiction of courts of Australian Capital Territory and the Federal Court of Australia.

Ordering

An email order by you is an offer by you to purchase a particular product at the price specified in the email. Flying Furniture reserves the right to accept or reject your offer or request for any reason, including, without limitation, the unavailability of any product, an error in the price or an error in the product description posted on the site. When or if significant currency exchange rate changes occur for orders of goods from international suppliers Flying Furniture reserves the right to refund money paid and prepare a new quote or invoice. There may be reasons why we cannot fulfill your order, therefore your contract with Flying Furniture only comes into existence when Flying Furniture advises you that it has accepted your order or request and your payment has been confirmed. Flying Furniture’s standard Terms & Conditions will apply to any order accepted by Flying Furniture.

Refund policy

Refunds are not automatic and are only applicable when the goods are defective and not structurally fit for purpose. A change of mind is not a reason for a refund. For every refund the postage or freight of items to and from Flying Furniture will be covered in all cases by the customer. Postage or freight costs and any other outside costs paid by Flying Furniture are not refundable items. Items not covered by the refund policy are tyres, tubes, rims, spokes, wheels, batteries, any custom produced item cut, moulded, altered from original or pre-assembled according to the customer's request. Items advertised as a special or offered as a "special" or at a discount or as "used" or as a "demo" or "marked" are sold "as is" and will not be considered for refund under any purposes. Any item incluing a bike or trike specially ordered from a manufacturer to the customers specification will not be considered for a refund under any circumstances. Flying Furniture will however endeavour to work with the customer in areas of dispute to adjust or modify the product within reason to the customer's satisfaction - if many hours of modification are required the customer will be responsible for the costs of any and all modification. Images used on the website are for illustration purposes only and may vary from the actual product. Parts and specifications can and often vary from time to time and no representation obtained from an outside or manufacturers website shown on the website here is binding. The customer may ask for full specifications used before purchase and if no complete specifications are supplied on a written quote/order the parts listed are not binding.

Cancellation policy

It is usual that Flying Furniture requests a pre-payment for an order. This pre-payment confirms your order. If an order is accepted and processed by Flying Furniture a full refund can not be made. An administrative and cancellation fee will be charged by Flying Furniture in the case of all orders once processed and a cancellation fee will be applicable and will range from a minimum of $300 (excluding labour and/or time charges which may also be added) to the full amount of the deposit paid for overseas orders placed with and paid to suppliers or banks outside Australia that cannot be easily recovered.

Prices and Products

Prices of products and delivery charges displayed on the site are current at the time of issue and are inclusive of GST, but may change at any time and are subject to availability. The availability of products is subject to change from time to time.

Delivery

Flying Furniture will use its best efforts to meet quoted delivery times in every case. Flying Furniture will not have any liability to you if it fails to satisfy in whole or in part the scheduled delivery time. Please note that if the courier company has to re-deliver the goods to you, Flying Furniture will not be responsible for any additional charges and any additional charges will be your responsibility and will be added to the credit card charge. If a product is sent by courier and is damaged or lost during transport and it is covered by insurance it is only covered up to the amount determined by the courier company used and any excess charged by the insurance company during a claim is the responsibilty of the customer. Any "free freight delivery" offer applies to freight being delivered to a standard address within our courier's normal Australian freight network and deliveries where our courier has to employ outside contractors ie remote areas may incur extra delivery costs payable by the customer.
 

Fraud

It is a violation of law to place orders under a false name or with an invalid cheque or an invalid credit card. Fraudulent ordering will be immediately reported to police and prosecuted to the fullest extent of the law.
